Beepz operates and manages the web applications, mobile applications or applications on other platforms or devices created and developed by Beepz (collectively, the “App”). The App serves serve as an intermediary between professional buyers and car sellers (collectively, the “Users” and individually, a “User”).
The present Privacy Policy (the “Privacy Policy”) sets forth the terms and policy concerning the usage, handling and collection ofUser information on the App.
In this Privacy Policy, Beepz may be referred to as “we”, “us”, “our”, and other similar expressions. This Privacy Policy has been prepared in accordance with the applicable laws of the State of Californiamade in accordance with applicable laws in Florida.
1. ACCEPTANCE OF THIS PRIVACY POLICY
All downloading, usage or access to the App signifies your acceptance of this Privacy Policy and its provisions, as may be revised by Beepz at its discretion. Any provisions of personal information on theApp will be governed by this Privacy Policy.
2. USER INFORMATION
By law, personal informationconstitutes information about an identifiable individual. Such information includes but is not limited to the User’s name, address, email, financial information, occupation and other relevant information.
Beepz will only collection provided voluntarily by Users on the App or in accordance with this Privacy Policy.
3. SECURITY AND SAFEGUARD OF PERSONAL INFORMATION
Beepz undertakes not to disclose or communicate any personal information provided on the App to any third party, except under the circumstances detailed in this Privacy Policy, or pursuant to applicable laws, regulations or an applicable court order.
Beepz has implemented various procedures to prevent unauthorized disclosure of users’ personal information. All such procedures prompt Beepz to take precautions and safety measures to protect Users’ personal information from disclosure and unauthorized access. The precautions and safety measures developed by Beepz will apply to its employees, and other third parties who may be granted access to personal information provided on the App. The disclosure and access to such personal information will be limited to the information that is strictly necessary to fulfill the purpose of the App. All disclosures of personal information by Beepz will always be for a specific and explicit purpose as set forth in this Privacy Policy. The personal information will only be disclosed and communicated to employees and third parties who are subject to confidentiality obligations that are as binding as those detailed in this Privacy Policy.
Beepz will only disclose personal information on a limited “as needed” basis. Beepz may disclose personal information to its employees, service providers, or other users to fulfill the purpose set forth by the App.
Further, all information collected through or on the App shall be protected from unauthorized disclosures, damage, deletion and destruction as a result of the procedures and systems implemented by Beepz.
4. MAINTENANCE OF PERSONAL INFORMATION
Users understand that personal information provided on the App will be stored in Beepz’s database servers, or in a server hosted by a third party. In such case, the third party will be subject to the terms of this Privacy Policy.
5. DISCLOSUREAND COMMUNICATION OF PERSONAL INFORMATION
Beepz will use the personal information provided on the App solely for the purposes listed in this Privacy Policy, except if the User consents to the communication of its personal information for another purpose.
Generally, the personal information provided on the App will be used to set out the purpose set out by the App, to consummate a transaction between Users for the purchase and sale of a vehicle. The personal information will be used in a reasonable manner to the extent necessary to fulfill the purposes listed in this section.
Users acknowledge and understand that personal information provided on the App may be used, communicated or disclosed by Beepz to fulfill the following purposes:
- to enter into a transaction between a professional buyer and a vehicle seller;
- to provide customized information relating to pricing, vehicle selection, professional buyers, and other similar information with respect to the services offered on the App;
- to inform Users of vehicles and opportunities that may be of interest;
- to communicate with Users regarding a transaction, payment, vehicle, potential buyer, or provide any other information;
- to respond to inquiries, questions, feedback or comments submitted by a User;
- to assess the App, its parts and functionalities;
- to improve the App and evaluate trends and user interest;
- to conduct research relating to the App and to the services offered thereon;
- forall other reasonable purposes as determined by Beepz at its discretion.
If a User explicitly consents to Beepz using its personal information, Beepz will be authorized to communicate and disclose the personal information based on the User’s explicit instructions and consent.
6. PAYMENT SERVICES
Any payments made using or involving the App will be made using an unaffiliated payment service, namely Braintree (the “Payment Service Provider”). All personal information provided by a User to the Payment Service Provider will be subject to the Payment Service Provider’s privacy policy and data collection policy, as opposed to this Privacy Policy.
7. THIRD PARTY LINKS
This Privacy Policy applies solely to theApp despite that itmay link to other apps or websites. Any links to third party websites or apps are provided for referece and informative purposes. Thethird party websites and apps are not governed by this Privacy Policy and Beepzhas no control over the third party website and app’s handling of personal information.
8. MODIFICATIONS
Beepz may modify this Privacy Policy at any time at its discretion. The revised Privacy Policy will be published on theApp and will be applicable as of its publication.
